Administrative Law is a type of law that sets the rules for how the government should deal with the general public.
At CLASP, we provide services on four main areas:
Housing Rights
Residential Landlord and Tenant disputes are largely governed by the Residential Tenancies Act, 2006, and decided at the Landlord and Tenant Board (LTB).
We assist tenants in rental housing with a range of legal issues including:
- Eviction
- Illegal lockouts
- Repair and maintenance issues
- Human Rights
- Harassment
- Illegal charges
We do not provide services to landlords. Note: Landlords seeking assistance can contact the Landlord Self-Help Centre.
Human Rights
Human rights complaints under the Ontario Human Rights Code are advanced at the Human Rights Tribunal of Ontario (HRTO).
We assist complainants with human rights complaints in the following areas:
- Accessibility issues in housing
- Accommodation-based unit transfer requests
- Discrimination in housing
- Discrimination in employment
Human rights complaints against service providers are accepted by referral only.
Social Assistance
In the area of Social Assistance, we provide services in appealing decisions to deny Ontario Disability Support Program (ODSP) to the Social Benefits Tribunal (SBT). We assist in
- Requesting internal reviews to the Disability Adjudication Unit (DAU)
- Filing appeal form to the SBT
- Gathering medical information from health care providers
- Representation at the SBT
Academic Honesty (on hold)
York University’s Senate Policy on Academic Honesty affirms student’s obligation to maintain its standards of academic honesty. If a student is investigated for a breach under the Senate Policy on Academic Honesty, they are owed procedural fairness in the process. A student may be invited to an Exploratory Meeting with the Faculty to discuss the alleged breach and resolution. If resolution is not reached at this meeting, the Faculty may hold a Formal Hearing before the Faculty committee to make a finding about the alleged breach and/or the appropriate penalty to be ordered.
At CLASP, we offer assistance to York students with:
- Advice on the Academic Honesty process
- Representation at the Faculty’s Exploratory Meeting
- Representation at the University Tribunal if a resolution is not reached.
